Plants developed by man through technology are susceptible to obtain exclusive rights of exploitation in Mexico and other countries under the figure of the Breeder’s Right (PBR) through the UPOV Treaty and the Law of Plant Varieties. PBR entitlements can lead the owner to prevent unauthorized production or reproduction (multiplication), packaging for propagation purposes, offering for sale, sale or other marketing, export, import or storage for any of the purposes mentioned. Likewise, the holder may authorize others to carry out these acts under the conditions and terms that the owner wishes to impose, subject to the safeguarding of the compulsory license.
